Hi,
Please advice me on below:-
1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.

I am planning to go to India for emergency purpose. I have valid stampped H1B visa till Jan'2012 with my previous employer X. Now I have been working for new employer Y since Jun'2009. I have got approved 797 and have all paystubs since then. Do I need to go for visa stamping in India with new 797 or I should be able to enter US with my previous company's stampped visa?
Any quick reply is very much appreciated.

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.
I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.
Does it mean that I have to move over to EAD if I get the offer?
Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

We have received our EAD cards without having Finger Print done. We have received FP notice and scheduled for the next week but received our EAD cards.
EAD cards says "No Finger print available" on the right corner. Will this cause any problems?

Do you know, how one could apply for a Visitor Visa without a Sponsorer in the US ?
What documents do they need to furnish ?
As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?

I have searched lot of threads regrading AC21 when the new is less. I am currently working in a city. I have applied for 485 on July 2. 140 is approved. I am planning to move to rural area in the same state. Since the location is rural, the pay is lower than pay specified in my current labor. Since they also sponsor GC, I am sure the pay is higher than the prevailing wage.
Under these circumstances, is it ok to use AC21. Is it possible to argue that the wage is higher than the prevailing wage in the new EVL to be submitted with AC21.
I am aware AC21 is for "same or similar job". What about pay? ANy issuew with this.

I'm a July 2nd eb3 filer. Never thougt I could file 485 on July just like many people. I started an eb2 Perm early this year with a new position same company. A month later after filed eb3 based 485, my Eb2 Perm got approved, then filed eb2 140.
The problem is my eb2 LC and pending 140 says that I'm holding a position. What can I do? should I withdraw eb2 140? Can I still take advantage of the pending eb2 140, or better leave it along?

Check not cashed is indication of missing mail, either by mailing services (USPS, FEDEX, ...) or in USCIS. Average time for check to be cashed is less than 10 days.
Whether you should open SR or re-apply, someone who faced similar situation can provide better answer.

I'm in a process of transfering my H1B to a new employer. I've already hired a lawyer and paid him his fee. The lawyer spoke to my employer and everything was going fine. Now, my new employer tells me that his company "froze hiring" untill further notice !?!
I'm wondering
1. Is my employer lying and why?
2. Can I somehow make my employer pay me back the money I already paid to the lawyer?
