I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

2. How sure about getting approval of H1B.
Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

I applied I-140 in EB2 NIW category. I need to apply for H1 extension as this is my 5th year. I need to talk to my employer.
I see because of retrogression one cannot file for I-485.
Can I file for extension of H1 after I get I-140 approval or do I have to wait for I-1485 filing.
Please advise.

Folks,
I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.
The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.
Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.
Your opinion would be appreciated.

Hi,
My EAD got expired in July and I got the Denial Notice of the H1B petition last week. My lawyer thinks it's got rejected because of my salary change and address change. So she's going to file a new H1B petition on a nunc pro tunc basis. What is nunc pro tunc? Is my case eligible to file such a petition?
And if not, what other options do I have?
Please give me some advice, any advice you think might work. Thanks!

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

Just read this on msnbc. Seems like they take away your electronic devices (laptop, digital camera, cellular, e.t.c) and then access all the info on the device. I am traveling in a weeks time and was taking with me all the above mentioned items. Now I am weighing the risk of traveling with my personal information on these devices. Not that i have anything illegal to hide, but still i consider this an invasion of my privacy. Any thoughts?!

If you can wait for AP to get approved that would be a better choice. When did you applied for AP? I know couple of my friends whose AP got approved with in a month. It all depends on case to case. Don't take it granted as 2-3 month.

Ajay K Arora from H1B1.com was a good lawyer for me. I was in KY at the time and had the luxury of choosing my own immigration lawyer. I did H1 + renewal, and RIR labor that got recently approved, but I am with a different company now, so can't use labor cert, and I have to put up with the company's law firm whose service is of course, awful.
