I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

A new report from the Economic Policy Institute makes the case that immigrants at all wage levels actually lift wages for US workers:A key result from this work is that the estimated effect of immigration from 1994 to 2007 was to raise the wages of U.S.-born workers, relative to foreign-born workers, by 0.4% (or $3.68 per week), and to lower the wages of foreign-born workers, relative to U.S.-born workers, by 4.6% (or $33.11 per week). Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

Hello All,
The officer at the SSN issuing center told me since my passport and the stamped I-94 have my maiden I will get an SSN also in the maiden name and not my married name.
However I had already filed for my EAD (form I-765) before getting this information with my married name which I need to change to the maiden name. I have received an appointment letter for biometrics/finger printing (FP) . What should be done now? Should I wait and tell the officer during the FP about this name change that I need or how should I go about it?

If you are working on H1 then dont renew your AP, you can always travel and enter using your H1. If you plan to use your EAD pretty soon (or your H1 is expiring soon and you dont plan to renew it ) then apply 60 days before you plan to start using EAD and you should be fine.
You can even apply for AP after the current one has expired, its just that you wont be able to travel till you get your new AP if you have abandoned your H1 status.

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

1. Does it really matter what date the 485 application was filed, if it was filed within the specified time-period ?
I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

i applied my wife's H4 visa renewal on Feb 2008 but received the USCIS Ack as April 2008. when i see the processing times now looks like the processing time for the I 539(H4 Renewal) is October 2007
Does any body have any understanding on the processing times on when my H4 Visa petition would be processed with USCIS ack date as april 2008 . any suggestions would be apreciated

You are fine. You can continue to work in US on the approved I-797. In US visa is required only to enter into United States. Once you cross the customs and walk into US that VISA is nothing. There after everything is I-94. with I797 you got new I-94 and that reflects your status.

Hi,
My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

I was born in Canada and moved to the U.S. when I was 8 years old. I was naturalized when I was 18 (4 years ago). I heard that when naturalized in the U.S, my Canadian citizenship was not lost (I never filed any paperwork with the Canadian government stating I wanted to give up my Canadian citizenship either). Is this true?
If so, can I apply for a Canadian passport? Should I do this? Are there any responsibilities/problems/repercussions that could occur if I do this?

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. This brings me to one of my pet peeves. It bothers me that the immigration laws and agency regulations favor some fields of study and disfavor others. Why for example are students in the STEM subjects(Science, Technology, Engineering and Math) given 27 months of "optional practical training" -- a euphemism for work permission --- while liberal arts students get only 12 months?
