I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.
1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?
Please suggest if there are better ways to handle the situation.
-- How long does it take to get H1-B visa under premium processing, if applied in 65000 pool?

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

I have an approved 140 with Sept 2005 PD
I have an I 140 and I 485 filed with Dec 2006. There is an RFE on this. I want to interfile I 485 with the approved I 140. Is there a possibility and if so what needs to be done.
I have submitted the response to the I 140 RFE. May be I will get a response in 2-4 weeks.
However, if the I 140 gets denied can I still Interfile my 485 with ealrier approved 140?
What are the options open for me to keep my 485 alive?

Dear All,
I just have one thing to say to you all. You did bring attention and top newspapers covered our plight. I am seeing newspaper articles from NYT, Business week, BBC and Washington post.
Remember everybody, It takes mighty work to shake this, and we did that mighty work and I think you shouldn't be overcritical and wait for the fruits of labor to bloom.
We will do it one day........ we shall overcome one day... :-)
Just keep this passion going, if steam fizzles out, everything will flatten out and we will have to be on this all over again, so never let that happen.

Hello,
I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.
Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?
I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

Iam in my 6th yr of H1b.
I have my I140 approved and I received my 3 yrs extension.
Question is can i shift jobs now? What are my options?
Once I move to the new job and file for GC, can I claim the old PD date ?
