    as per my knowledge"One should file a new LCA for an H1B petition" if work location changed from one state of US to other state.

    Can you please tell me the process and how long will it take for this LCA approval?
    After LCA approval, do I have to go for Visa stamping though we have valid visa?
    How much does it costs for new LCA?

    I am eagerly waiting for responses as I need it urgenetly.

    Hi,

    My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.

    1 ) we applied for COS from H4 to H1 By Company A by premium processing.

    2 ) Company B H1B from H4 is also under process.

    Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

    If she gets J1 visa, then she would have to stay outside of US for 2 years at the end of J1 visa before she can get her greencard (even if you become citizen and apply for her). Another option would be that she would have to work in medically underserved region for 2-3 years to obtain J1- waiver, before she can apply for greencard.

    None of this should affect YOUR greencard approval.

    Do my employer need to file I-140 within 45 days of labor certification? Is this a law now?

    It is part of a proposal to stop labor substitution. I hope it becomes the rule!

    My son came to USA on H4 Visa. He completed his studies on F1 Visa and worked for some time on H1B Visa.

    Then he went to Canada for higher studies. He holds Canada PR.

    I am in US. If I apply for his I 130, would there be probem him visiting US on B2 Visa.

    hi all,

    I've found myself in abit of a predicament. My application for H1B extension is still pending (filed in September) and all I have right now is a Notice of Action from the immigration department.

    While waiting, I have been laid off this week... I intend to return back to my home country before my last day (Dec 31).

    My question is: Would I be able to make a round trip? That is to say, come back to the US on a tourist visa a week after I got home? I need to come back to sell what I own here and settle other things.

    A friend told me that it is better to overstay for however long (maybe an extra week, I don't plan on too long) I need to get my things in order than try to take the chance of coming back. What do you think?

    I appreciate any advice you can give.

    Hi friends,
    I got my I-140 approval in premium processing. But unfortunately, USCIS printed the new labor filing date (2010) when the attorney requested my I-140 to capture the old priority date which is June2004. My law firm already contacted USCIS to issue a revised notice with the old priority date (June2004).
    How long does USCIS take to issue a revised I-140? Any feedback is greatly appreciated. Anything that we can do to expedite the release of the new I-140 notice with correct priority date?

    Did you use your A number when you filed your new I 140 , ??

    If so i think your I 485 will be automatically updated ..

    My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

    Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs.     Hi all,

    I am in a confusing situation would really appreciate some suggestions.

    I am the primary applicant and my spouse is the beneficiary for the 485 applications that were sent on July 07. I have received a RFE on my 140. My PD is 12/2004 EB3-India.

    My spouse company may be willing to apply for her under EB1C. I have a few questions:

    1. Can she apply for 140/485 simultaneously? (I heard concurrent applications are not possible)
    2. Can the existing 485s be jeopardized by the new 485s?
    3. Do we need to go in for FP and do our Medicals again if we apply for 485s again or are they going to reuse what we have already sent?
    4. Do we need to withdraw the existing 485s at some point of time
    5. Is this worth the hassel of complicating the applications?

    Please help!
